PURPOSE OF THIS NOTICE

This policy is provided in accordance with ART. 13 of EU Regulation 679/2016 to all parties who use and interact with Società Agricola Montalbera s.r.l., web services, and is accessible online at: http://www.montalbera.it which is the home page of the official site ofSocietà Agricola Montalbera s.r.l.The notice refers exclusively to the site http://www.montalbera.it property of Società Agricola Montalbera s.r.l.and does not in any way represent any other websites linked thereto.

The policy also refers to Recommendation number 2/2001 that the European personal data protection authorities – under the umbrella Group founded by art. 29 of European Directive N° 95/46/EC - adopted on 17th May 2001 to establish some minimum requirements for the online collection of personal data and, in particular, the methods, times and nature of the information that processing controllers must provide users upon the latter’s access to web pages, independently of the purposes of said access.

DATA CONTROLLER

Società Agricola Montalbera s.r.l. is the data processing controller, represented by their legal representative Walter Morando and registered in Via Montalbera, 1 – 14030 Castagnole Monferrato (At) Tax Reg. Code 00633260054. The afore-mentioned may exercise his rights via written request to Società Agricola Montalbera s.r.l.at the legal premises postal address or via email at privacy@montalbera.it

 

DATA PROCESSING FACILITIES

All processing regarding the site’s Web services is undertaken in the controller’s premises mentioned above or otherwise exclusively by specially delegated technical processing staff, or by any other occasional maintenance operators. No data deriving from the web service will be communicated or shared. All personal data supplied by users asking to receive information (such as newsletters, etc.) will be used for the sole purpose of providing the service required.

TYPES OF DATA PROCESSED

Navigation data

Over time, and in the process of normal operations, the computer systems and software procedures used for the functioning of this website acquire some personal data the transmission of which is implicit in the use of Internet communication protocols. This information is not gathered in association with identified parties, but by its very nature may, through further processing and associations with data held by third parties, lead to the identification of users. Data supplied voluntarily by the user

Should a user explicitly and voluntarily choose to send an email to any of the address indicated on the site, this entails the subsequent acquisition of the sender’s address insofar as it is necessary in the event of a response, as well as any personal data included within the correspondence.

OPTIONAL DATA TRANSFER

Notwithstanding that specified for navigation data, users are free to provide personal data in request forms sent to the controller or, in any case, that data indicated in requests for informative material or other communications. Should this information not be transmitted, this may render any requests impossible.

DATA PROCESSING OF MINORS

Unless upon prior consent by a parent or legal guardian, no person under the age of eighteen may send information to this website, nor can they make purchases from this site without the aforementioned consent, unless allowed by the law in force.

PURPOSES OF THE PROCESSING

Any information provided voluntarily by the user may be processed exclusively for the following purposes:

  • registration, activation and maintenance of accounts in order to use the site’s services
  • anonymous data is used, also in aggregated form for the elaboration of studies and statistics

Personal data will be processed by electronic or manual tools, with methods compatible with the purposes thereof, so as to guarantee confidentiality, security and integrity of the data.

DATA PROCESSING AS PER THE LAW

Società Agricola Montalbera s.r.l.will process your data lawfully, adopting the appropriate security measures (Art. 32 GDPR), whenever the processing:

a) is necessary for the execution of a contract in which the interested party is a party or in the execution of pre-contractual measures adopted upon request thereof;

b) is necessary to fulfil a legal obligation to which the controller of the processing is subject;

c) is necessary for the pursuit of the legitimate interests of the processing controller or of third parties, on condition that these do not prevail over the interests or rights and fundamental freedoms of the interested party requiring the protection of their personal data;

d) the interested party has expressly consented to the processing of their personal data for one or more specific purposes.

 

DATA CONSERVATION

Your personal data, subject to processing for the aforementioned purposes, will be conserved for the duration of the contract and, subsequently, for the time in which the Controller is subject to conservation obligations for tax purposes or other reasons provided by the law or other regulations.

Data used for security purposes (protection against intentional damage to the site) are conserved only for the time necessary to fulfil the afore-mentioned purpose.

 

DATA COMMUNICATION

Your personal data will be communicated to third parties exclusively for requirements linked to the indicated purposes and in particular to the categories listed below:

    • agents, accountants and lawyers providing services functional to the above-mentioned purposes;
    • judicial or administrative authorities, in order to fulfil all obligations of the law.

DATA PROFILING AND DISTRIBUTION

Your personal data is not subject to distribution nor to any entirely automated decision-making process, including profiling.

 

RIGHTS OF THE INTERESTED PARTY

At any time, the user may exercise, as per articles 15 to 22 of GDPR, the right to:

a) ask for the confirmation of the existence of their personal data;

b) obtain information on the purposes of the processing, the categories of the personal data, the recipients or categories of recipients to whom the personal data has been or will be communicated and, where possible, the conservation period;

c) demand the correction and cancellation of the data;

d)  obtain a limitation of the processing;

e) demand data portability, or rather receive it from a processing controller, in a structured format in common use and readable from an automatic device, and transmit it to another processing controller freely;

f) oppose the processing at any time and also in the event of processing for direct marketing purposes;

g) oppose an automated decision-making process regarding physical people, including profiling;

h) ask the processing controller for access to personal data and the correction or cancellation of the same or limitation of the processing that regards them or to oppose the processing thereof, as well as the right to data portability;

i)   revoke consent at any time without prejudicing the lawfulness of the processing based on the consent given before said revocation thereof;

j)   file a complaint to an inspection body.

Winery visits

The Montalbera Wine Shop is open from Monday to Friday from 10 am to 6.30 pm and on weekends from 10 am to 7 pm with the possibility of tasting and buying wine in compliance with the regulations in force regarding COVID-19.
Winery visits are only possible Monday to Sunday from 10 am to 6 pm, with the relative possibility of tasting and purchase.
